These Terms and Conditions govern your use of the Solid Built Man™ website and your engagement with Solid Built Man™ coaching services. By using our website or engaging our services, you agree to these Terms and Conditions. Please read them carefully.

1. ABOUT SOLID BUILT MAN™

Solid Built Man™ (ABN 30 121 418 117) is an Australian coaching business providing practical coaching and education for tradie leaders.

2. OUR SERVICES

Solid Built Man™ provides practical coaching, educational content and related services for tradie leaders.

Our services may include one-on-one coaching programs, introductory conversations, educational resources, online content and other services offered from time to time.

We will explain and agree on the specific services, inclusions, fees, and arrangements for any paid program before enrolment.

3. COACHING AND IMPORTANT LIMITATIONS

Solid Built Man™ provides coaching and educational services.

Our coaching is not a substitute for:

  • medical advice or treatment;

  • mental health treatment or psychological services;

  • financial advice; or

  • legal advice.

We do not diagnose, treat or provide clinical services for mental health conditions or other medical conditions.

If you require professional medical, psychological, financial or legal assistance, you should seek advice from an appropriately qualified professional.

Results from coaching vary between individuals and depend on factors including your circumstances, decisions, effort, participation and follow-through. We do not guarantee any particular outcome or result.

4. LIFE SITE WALK™

The Life Site Walk™ is a complimentary 60-minute introductory conversation.

You are not obligated to purchase any coaching services after the conversation.

You may cancel or reschedule the Life Site Walk™ with reasonable notice.

5. PROGRAM ENROLMENT AND PAYMENT

Enrolment in a paid Solid Built Man™ coaching program is confirmed when you accept the applicable Coaching Agreement and payment arrangements.

  • We will provide fees and payment arrangements before enrolment.

  • We process payments through our nominated payment provider.

  • Prices are stated in Australian dollars.

  • GST will be included where applicable.

  • Any payment plan or instalment arrangements will be set out in the applicable Coaching Agreement.

6. CANCELLATION, RESCHEDULING AND REFUNDS

For coaching sessions:

  • Sessions cancelled with more than 24 hours' notice may be rescheduled at no additional charge.

  • Where less than 24 hours' notice is provided, the session may be treated as used unless otherwise agreed.

  • If you need to withdraw from a program, please contact us as soon as possible.

We will consider any refund or cancellation request in accordance with the applicable Coaching Agreement and your rights under the Australian Consumer Law.

Nothing in these Terms and Conditions limits or excludes any rights or remedies that cannot legally be excluded.

7. CONFIDENTIALITY

We respect the privacy and confidentiality of information shared during coaching.

We will generally treat information shared during coaching as confidential, except where:

  • disclosure is required or permitted by law;

  • disclosure is necessary to protect someone's safety;

  • you give us permission to disclose the information; or

  • disclosure is reasonably necessary to provide our services.

Our handling of personal information is also governed by our Privacy Policy.

Clients are expected to respect the confidentiality of information shared by Solid Built Man™ during coaching and not disclose personal information about other individuals discussed during sessions.

8. INTELLECTUAL PROPERTY

All original content, materials, systems, frameworks, tools, documents, exercises, written material, website content, graphics and other intellectual property created by Solid Built Man™ remain the property of Solid Built Man™ or the relevant rights holder.

Materials provided as part of a coaching program are provided for your personal use only.

You must not, without our written permission:

  • reproduce or commercially distribute our materials;

  • sell, provide or distribute our materials to another person;

  • copy or substantially reproduce our systems, frameworks or materials;

  • use our materials to create or deliver a competing coaching program; or

  • represent our materials as your own.

Participation in a Solid Built Man™ program does not give you ownership of our intellectual property.

9. YOUR RESPONSIBILITIES

You are responsible for:

  • providing accurate information where reasonably required;

  • participating honestly and actively in coaching;

  • making your own decisions about how you apply information provided during coaching;

  • seeking appropriate professional advice where required; and

  • treating Solid Built Man™ staff, contractors and service providers respectfully.

You remain responsible for your own decisions, actions and outcomes.

10. NO GUARANTEE OF RESULTS

Solid Built Man™ does not guarantee that coaching will produce a particular personal, relationship, professional, financial or other result.

Our services provide coaching, structure, tools, education, accountability and support. The way you apply that information and the decisions you make remain your responsibility.

11. AUSTRALIAN CONSUMER LAW

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights, guarantees, remedies or protections you may have under the Australian Consumer Law or any other applicable law that cannot legally be excluded, restricted or modified.

Where the law allows us to limit our liability, we may do so only to the extent permitted by law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with a service, you may have the right to:

  • cancel your service contract with us; and

  • receive a refund for the unused portion or compensation for its reduced value.

You may also be entitled to compensation for other reasonably foreseeable loss or damage.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Solid Built Man™ is not liable for loss or damage arising from your use of our website or services where that liability can legally be excluded.

Nothing in these Terms and Conditions excludes liability that cannot legally be excluded, including rights and remedies available under the Australian Consumer Law.

Where our liability can legally be limited, our liability will be limited to the extent permitted by law.

13. WEBSITE USE

You agree to use the Solid Built Man™ website only for lawful purposes.

You must not:

  • attempt to damage, disrupt or interfere with the website;

  • introduce malicious code or harmful material;

  • gain unauthorised access to the website or related systems; or

  • use website content in a way that infringes our intellectual property rights.

Website content may be updated, changed or removed from time to time.

14. THIRD-PARTY WEBSITES AND SERVICES

Our website or services may contain links to third-party websites or use third-party services.

We are not responsible for the content, availability, security or privacy practices of third-party websites or services.

You should review the relevant third party's terms and privacy policy before using their services.

15. PRIVACY

Our collection, use and handling of personal information is governed by our Privacy Policy.

These Terms and Conditions are governed by the laws of Victoria, Australia.

Subject to any rights you may have under applicable law, disputes relating to these Terms and Conditions will be subject to the courts of Victoria, Australia.
